Terms of Service

By using Programming Car Pro services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services. We reserve the right to modify these Terms at any time. Your continued use of the site following the posting of revised Terms means that you accept and agree to the changes.

Programming Car Pro provides remote OEM automotive programming services, including ECU/PCM programming, key programming, immobilizer programming, and body control module (BCM) programming for American and international vehicles. We also offer a professional key reference database and the sale of automotive diagnostic scanners (EAATA 90, Thinkcar Platinum 391, TJS120 Jump Starter).

Our services are provided on an as-is basis. We make no warranties regarding the availability, accuracy, or functionality of our services, except as expressly stated in this agreement.

You must be at least 18 years old and have the legal authority to enter into this agreement. You represent and warrant that you are not a person or entity prohibited by law from receiving our services, including but not limited to individuals or businesses engaged in illegal activities.

If you are a locksmith or automotive technician, you represent that you hold all necessary licenses and certifications required by your jurisdiction to perform automotive key programming and module programming services.

You agree to use our services only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the services. Prohibited behavior includes: harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content, disrupting the normal flow of dialogue within our site, and attempting to gain unauthorized access to our systems.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You acknowledge that you own or have the legal right to program all vehicles you request programming for. Programming Car Pro will not program vehicles for which you do not have ownership or legal authorization.

Remote Programming Process: When you book a remote programming session, you agree to provide accurate vehicle information (VIN, year, make, model) and to have a compatible scanner with Remote Diagnostic capability connected to your vehicle during the session. You acknowledge that our technician will not have physical access to your vehicle and will not access your laptop or personal computer beyond the Remote Diagnostic code you provide.

Equipment Requirements: You are responsible for providing and maintaining all equipment necessary for remote programming sessions, including a compatible scanner (Thinkcar, EAATA, Launch, TOPDON, Autel, etc.), a stable internet connection (minimum 10 Mbps), and a charged vehicle battery (minimum 12.4V). Programming Car Pro is not responsible for equipment failures or compatibility issues.

Successful Programming Guarantee: Programming Car Pro guarantees that if a programming session is completed and the module is successfully programmed according to OEM specifications, you will only pay the agreed-upon service fee. If programming fails due to our technician's error or our software limitations, you will not be charged. However, if failure is due to client-side issues (incompatible scanner, low battery, incorrect software, or vehicle-specific problems), a $50 diagnostic fee applies.

Cancellation Policy: You may cancel a scheduled session up to 24 hours before the appointment time for a full refund. Cancellations made within 24 hours of the appointment are subject to a $50 cancellation fee.

All scanner and equipment sales are final. We do not accept returns on diagnostic scanners unless the product arrives damaged or defective. Damaged or defective products must be reported within 7 days of receipt.

Shipping is provided via USPS or private carrier to addresses within the USA and Canada. Shipping times are estimates and are not guaranteed. Programming Car Pro is not responsible for delays caused by carrier issues, weather, or customs.

You are responsible for providing accurate shipping information. Orders shipped to incorrect addresses due to customer error will not be reshipped at no charge.

International Orders: We do not currently ship to countries outside the USA and Canada. Any orders placed for international addresses will be cancelled and refunded.

All prices are quoted in USD. Payment is processed through Stripe and must be completed before services are rendered or products are shipped.

Pricing for programming services varies based on vehicle type, service complexity, and market conditions. We reserve the right to adjust pricing with 30 days notice.

Payment Failure: If a payment fails, your session or order will be cancelled. You may reschedule or reorder once payment is successfully processed.

Refund Policy: Refunds for programming services are issued only in cases of service failure as described in the Successful Programming Guarantee section. Refunds for product orders are limited to damaged or defective items reported within 7 days of receipt.

All content on programmingcarpro.com, including text, graphics, logos, images, and software, is the property of Programming Car Pro or its content suppliers and is protected by international copyright laws. You may not reproduce, distribute, transmit, or display any content without our prior written permission.

You retain ownership of any content you submit to Programming Car Pro (such as photos, VINs, or session notes). By submitting content, you grant Programming Car Pro a non-exclusive, royalty-free license to use, reproduce, and display that content for service delivery and quality improvement purposes.

To the fullest extent permitted by law, Programming Car Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption, arising out of or related to your use of our services or site, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of or related to these Terms or our services shall not exceed the amount you paid for the specific service or product that gave rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

Our services and site are provided on an "as-is" and "as-available" basis. Programming Car Pro makes no representations or warranties of any kind, express or implied, regarding the operation of the site or the information, content, or materials included on the site.

We do not warrant that our services will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant that defects will be corrected or that our site or servers are free from viruses or bugs.

To the fullest extent permissible under law, Programming Car Pro disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

You agree to indemnify, defend, and hold harmless Programming Car Pro, its owners, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our services or site; (b) your violation of these Terms; (c) your violation of any law or regulation; or (d) your infringement of any third-party intellectual property or privacy rights.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law provisions.

Any dispute arising out of or related to these Terms or our services shall be resolved through binding arbitration administered by JAMS (Judicial Arbitration and Mediation Services) in Miami, Florida. The arbitration shall be conducted in English and shall be limited to the dispute between you and Programming Car Pro. You agree to waive your right to a jury trial and your right to participate in a class action lawsuit.

The arbitration shall be conducted by a single neutral arbitrator. Each party shall bear its own costs and attorney's fees, and the parties shall share the arbitrator's fees equally. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Notwithstanding the above, Programming Car Pro may seek injunctive relief in any court of competent jurisdiction to prevent irreparable harm or to enforce intellectual property rights.

Programming Car Pro may terminate your account and access to our services at any time, with or without cause, and with or without notice. Cause for termination includes, but is not limited to: (a) violation of these Terms; (b) illegal activity; (c) non-payment of fees; or (d) conduct that Programming Car Pro deems harmful to its business or reputation.

Upon termination, your right to use our services ceases immediately. You remain liable for any outstanding fees or charges incurred prior to termination.

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Programming Car Pro regarding your use of our services and site. These Terms supersede all prior negotiations, representations, and agreements, whether written or oral.
